Listening to the news conference it is amazing some of the questions that come in and then the lack of accepting the answer.

I do enjoy the engineer that is humours and witty. Haven't caught his name yet...think it is Mike.

I have no problem with Minot buying out all of the home owners for what Minot has taxed the value of the house or business but to take it be enimite domain is not right. If the house is valued at 125000 for taxes then pay 125000 for it if there is 3 mortages on it so be it. Minot also has all of the property that is being developed so thy have an option of trading lots for lots. A lot is only worth so much in the city It would cut back on a lot of epenses for the city.

I don't like the idea of continuing the naws money and etending forever now and let all of the rural people for Minot development

Eminent domain I imagine will only be used if you have situations where a very few minority are blocking the majority. I am not a fan of eminent domain either but when it comes to situations like flood protection I'm afraid, just like exploring for oil, it is a necessary evil.

Everyone will have ability to take valued buyout. Those that choose not to and end up being in the minority to their neighbors or whatever will end up having to "settle."

Even with the government land grab of eminent domain, I "believe" that they have to deposit an amount of money with the clerk of court that is "fair market value" for the property. The owner's right to object is not to whether or not the government can take the land, but to the "fair market value", and that is what would be settled in a court challenge.

At least that is the process that the state and the city of Devils Lake have been using around here for our dike and road projects.

The city land is west of the new wal-mart and some west of ING on north hill

There doesnt need to be enimate domain. There is a taxable value on every house in Minot. Lay the check on the table and get to work
Some of the houses in the flood zone have a value before the flood of 70,000 then that is what the owner gets if he wants more good luck the court will not allow the city to give more to one and not the other
There is too much of the emimate domain used by the city attorney

I don't know if I'm not following or if you aren't. Eminent domain would only be used if the landowner argued against the tax eval or whatever the city chooses as the fair market value or whatever we want to tag the price tag.

Therefore, the city will not hold back a project. They will take it by eminent domain and offer the person whatever they offered other people during the buyout. Of course, the only reason we get to eminent domain is the homeowner/landowner disagrees. Then it goes to court to be settled.

I'm sure there is some other red tape stuff as I am not on the up and up with this sort of thing but the bottom-line a piece of property will not be just taken without payment.

Allen,

KXNews is at it again with their over bearing journalism. I really like KXNews and think they are the best in the whole entire state when it comes to what they do. But man, they sure like to make stories that teeter on the truth over this. It is damaging to have them do it.

But on that note, I swore when I sat and listened to the press conference that changing water management in the dams would do little. As in, they would have to drastically be changed. Any change in what was already agreed upon for over 20 or however many years it is would create a ripple effect. If the answer is to move more water through the system then Towner would be hurt longer. We would danger normal operating pool levels. And the list goes on. Simply put, changing the management would have a big change factor on everything throughout the basin.

But on that note, can the dams even handle an event we had anyway?? I got the impression the answer was no unless capacity was increased. I am not sure guessing water discharges is the answer. KXNews definitely thinks so.

And I do have a question to Perry at KXNews. What happens if the rain event that sent us over the top falls where no dam structure can slow it? In all honesty, if that rain event happened below the dams there is absolutely NO flood protection. We see what big amounts of rain in the Des Lacs can do! So I hope Perry and the team use a little better "gotcha" reporting.

I don't know, just something that actually made me lay in bed a bit last night and ponder over.
