Fargo man fined for elk poaching in TRNP

BISMARCK — Lucas Pagel of Fargo has paid a fine for unlawfully taking an elk from Theodore Roosevelt National Park, U.S. Attorney Timothy Purdon announced today in a press release.


On Sept. 6, Pagel and his father, Randy Pagel hunted elk outside the west boundary of the park’s South Unit, north of Medora in Billings County. Lucas Pagel had an either-sex elk license for Unit E3.


Lucas Pagel shot through the park fence and wounded a bull elk. He shot a second time, killing the elk within the park, according to the release.


They entered the park by crossing under a fence, quartered it and transported the elk to Fargo, according to the release.


Lucas Pagel paid $1,525 for unlawfully taking, possessing and transporting the elk in violation of the Lacey Act; paid $500 to the North Dakota Report All Poachers program in-lieu of forfeiture of the firearm used to take the elk; and paid $500 to the park. He forfeited the cape, rack and meat to the park.


Randy Pagel paid $75 for unlawfully removing the elk from the park, according to the release.

It goes to prove that some people will do anything to get to shoot an elk behind a fence.

As much as I'm sick of this debate on high fenced operations I have to admit that was really funny.

As much as I'm sick of this debate on high fenced operations I have to admit that was really funny.
What is not funny is the violation.   I was wondering how many elk hunting violations there are in ND each year.    I have hunted elk in several states and I would say there was less elk violations than deer.  Might be the difference in hiunters or maybe it is harder to spotlight elk??

that kinda blows the belief that the lacey act only pertained to animals leaving the state.  this animal went to fargo so stayed within the state.  hmmm.

I don't think the fine was nealy enough,Should add azero to the back of all the fines, plus lose their hunting rights,for 5-10 yrs.You can't go any where and hunt a bull elk for $2575.I think I'll start hunting MOOSE and ELK every yr. in N.Dak.If it is only going to cost me $2500 if they catch me.

This is actually a really good point.

There's NOWHERE you can hunt a bull elk for that kind of money.

Once in a lifetime tag and the hunter screws is up??  On top of that he shot it INSIDE a national park.  Should be a huge fine, and a loss of hunting privaledges for a number of years.

Im curious how they were able to prove that this was shot illegally. If a warden saw them, they wouldnt have 'transported it to fargo', they would have been fined on the spot and the animal confiscated. Did they brag about it to someone who turned them in? Seems a little strange....

Looks like a true definition of the Lacey Act if you ask me. Read the 1900 charter and poached is one of the first words. And in a National Park? This guy should never hunt again. Yet; if you consider the law, and read the post it becomes quite obvious. The only thing not listed is the defendants attorney fees to make it a non felable offense. A felon is not supposed to posses a gun; yet he donated to get his back, as the article stated. Looks to me that the state was happy with their side of the "Bargain". It would interest me to find out what genre of society was the one who reported it to the Report All Poachers Program. After validating the article in the Tribune; My opinion is somewhat stuck in the middle between a father taking his son hunting for the first time, or the duo that beat up the White Sox first base coach. Not that anyone wanted my $75 Dollars worth.

I got a great idea. Why don't some of you get an education, get a law degree, run for judge, then when you get elected you can hand out fines and sentences higher than the recommended amounts for crimes committed that come before you.

It never fails, someone gets busted for a wildlife offense and the fines are never enough, the guy got off too easy, blah, blah, blah. Apparently someone thought justice was served or it wouldn't have been settled. It was an elk that happened to be on the wrong side of a fence, get over it. Pick up a paper and see the crimes committed against humans, particularly defenseless children, and see what the sentences are for those crimes.

I'm not blaming it on the elk or suggesting  anyone forget it ever happened. What I'm saying is everytime someone gets fined for illegal behavior regarding wildlife violations someone (usually multiple someones) comes on here and bitches about the sentence not being harsh enough. Was it a deplorable act? Yes it was, no doubt about it. It cost the two of them $2,600.00 and they have their names in the papers across the state.

Seems childish for someone to suggest the fine was small enough that it encourages them to poach a moose or an elk but if they truly feel that way have at it. There probably isn't a person on this site, or living for that matter that hasn't broken a law at one time or another. Speeding, open container, drunk driving, shooting someone elses pheasants or geese, and the list can go on and on. The holier than thou attitude gets old after awhile, just saying...

 $ 1500  to one hunter could be LOTS AND LOTS of money and he might have to take out a loan and make payments.   $ 1500 to another hunter could be pocket change , Only setting him back about as much as buying a postage stamp sets the rest of us back.    Hunting rights are golden to most everyone.          Just saying
